General terms and conditions
We are a non-smoking hotel; the legal smoking ban applies in the entire hotel building.
Arrival and departure: The rooms are ready for occupancy at 3 pm on the day of arrival. On the day of departure we will make the room available to you until 11 am. The room cards are to be handed in at check-out.
Deposit: Deposits on existing bookings can be made voluntarily. However, these must be received by 3 days prior to arrival. Please note that any bank charges incurred will not be covered by us. Our bank details: IBAN: DE26 6809 0000 0018 6223 00 / BIC: GENODE61FR1.
Booking: Please note that when you make a booking, we can confirm the category, but not a specific room number or floor. However, we will gladly take your wishes into consideration.
Half board: For bookings with half board, a table in our restaurant will be reserved directly for you. You are welcome to indicate your desired time in our reservation before arrival, Tel.: 07651-805 402. We ask you to take your table in the restaurant until 20:00.
Dogs: Dogs are not allowed in the whole hotel!
Konus: You can use buses and trains free of charge in the southern Black Forest. You will receive the KONUS guest card upon arrival at our reception. It is valid in the registered period of your stay on the routes of all buses and railroads 2nd class; except IC, ICE and mountain railroads. The KONUS guest card is only valid in connection with a photo ID. Children under 6 years travel free of charge.
Visitor's tax: The visitor's tax is € 2.90 per person and day of stay for adults and young people aged 16 and over. Children and teenagers from 6 to 15 years pay 1,20 €. (Tourist tax statutes Titisee-Neustadt - 2022).
Food allergies: We always have special food available for allergy sufferers (gluten, lactose). Please inform us of any allergies prior to your arrival. We cannot accommodate unannounced food intolerances. Despite the greatest possible care, we cannot exclude the possibility of traces of allergens in dishes.
Parking: free parking is available in our hotel parking lot. When entering, simply pull a parking ticket; this will be validated for you free of charge. For longer stays you can get a long-term parking ticket at the reception. We will be happy to reserve a garage for you for € 15.00 per night, subject to availability.
Prices: All prices are in Euro including VAT.
Sauna: Access to our sauna area is allowed to children over 14 years.
Cancellation conditions in general: After confirmation of the room reservation by our guests we hold a room ready. In case of cancellation, last-minute change or early departure, we allow ourselves to charge for the loss we incur. Up to 8 days before the date of arrival cancellations are free of charge, in the period 7 to 4 days we charge 50 %, from 3 days before departure 80 % of the agreed price. In case of early departure or no-show, 100 % will be charged. We recommend that you take out travel cancellation insurance!
Cancellation conditions Christmas / New Year's Eve: For bookings in the period from 22 December to 02 January, special cancellation conditions apply: up to 21 days before the date of arrival, cancellations are free of charge, in the period from 20 to 14 days we charge 50 %, from 13 days before departure 80 % of the agreed price. In case of early departure or no-show, 100 % will be charged. We recommend that you take out travel cancellation insurance!
Vegans / Vegetarians: We do not offer vegan food in the house; for vegetarians there are alternatives for lunch and dinner.
Wellness / Beauty program: Our wellness lounge offers cosmetic treatments and massages. To ensure that your treatments run smoothly, we recommend that you book your appointment in advance. Payment: We accept VISA, Mastercard, EC card and cash payment.
Rooms: All rooms are equipped with bath and/or shower, WC, hairdryer, bathrobe and terry slippers on loan, minibar, safe, satellite TV, telephone, some with balcony or terrace.
GENERAL TERMS AND CONDITIONS
Scope of application
These General Terms and Conditions (GTC) apply to all contracts concluded with TRESCHERS SCHWARZWALD AM SEE, Seestraße 10, 79822 Titisee-Neustadt (hereinafter referred to as "the Hotel"). They can be changed or replaced by individual case regulations. Consumers in the sense of the Terms and Conditions are natural persons with whom a business relationship is entered into without a commercial or independent professional activity being attributable to them. Entrepreneurs in the sense of the terms and conditions are natural or legal persons or partnerships with legal capacity with whom business relations are entered into, who act in the exercise of a commercial or independent professional activity. Clients in the sense of the terms and conditions are both consumers and entrepreneurs. Deviating, conflicting or supplementary general terms and conditions of the client shall not become part of the contract, even if known, unless their validity is expressly agreed in writing.
Conclusion of the guest accommodation contract
The guest accommodation contract (accommodation contract) can be concluded in writing, orally, by telephone or by conclusive behavior. The guest accommodation contract also applies to all participants listed in the application, for whose contractual obligations the applicant is liable as for his own obligations. The conclusion of the guest accommodation contract obligates both contracting parties to fulfill the contract, regardless of the duration of the contract. In the case of hotel accommodation, the guest accommodation contract is concluded as soon as the room has been ordered and confirmed or - if a confirmation was not possible due to time constraints - made available. If the content of the room confirmation differs from the content of the registration, a new offer of the hotel exists, to which the hotel is bound for a period of 2 days. The contract is concluded on the basis of this new offer if the guest declares acceptance within the hotel's binding period.
Reservations
If rooms or other services (e.g. meals) are reserved on an option basis, the option dates are binding for both contracting parties. After expiration of the agreed option period, the hotel may freely dispose of the rooms and services booked on an option basis without consultation. Reserved rooms confirmed by the hotel will be made available from 3:00 p.m. on the day of arrival and until 11:00 a.m. on the day of departure.
Terms of payment
Invoices can be paid in cash (€) and by EC card (Eurocheque card, Maestro with PIN). We also accept the following credit cards: Mastercard and Visa. If the invoice amount exceeds € 1.000,- or if the guest stays longer than 6 days in the hotel, the hotel is entitled to issue individual interim invoices and to demand their payment from the guest. Invoices are due immediately.
Advance payments
The hotel is entitled to demand advance payment from a guest in the amount of the accommodation price upon conclusion of the guest accommodation contract. Advance payments on existing bookings can also be made voluntarily. Advance payments and deposits must be received 3 days prior to arrival. Any bank charges incurred will be borne by the guest. Cancellations, cancellation fees
Cancellation by the customer of the contract concluded with the hotel requires the consent of the hotel in text form. If this is not done, the agreed price from the contract must be paid even if the customer does not use contractual services. In cases of cancellation of reservations by the guest or non-utilization of the services offered by the hotel/restaurant, the contractual services ordered and reserved but not utilized by the guest but offered by the hotel (in particular for the accommodation of the guests) will be charged to the guest by the hotel at the following flat rates:
Cancellations between the 7th and 4th day before arrival: 50 % of the booked service.
Cancellation between the 3rd day before arrival: 80 % of the booked service
In case of no-show or early departure: 100 % of the booked service
For bookings in the period 22.12. to 02.01. separate cancellation conditions apply:
Cancellations between the 20th and 14th day before arrival: 50 % of the booked service
Cancellation between from the 13th day before arrival: 80 % of the booked service
In case of no-show or early departure: 100 % of the booked service
The cancellation fees will be reduced by the amounts that are obtained by subletting the cancelled rooms. The above cancellation fees will also apply if the ordered and reserved services are only partially canceled by the guest, in which case the aforementioned lump sums refer to the part of the services that was canceled, or if the guest does not make use of the ordered and reserved services without explicit cancellation. In order to save you from unpleasant cancellation costs in case of no-show, we offer hotel cancellation insurance through Hanse ERV. We will gladly send you the services and conditions.
Room categories
Price differences result from the different location, size and equipment of the rooms.
Room provision, handover and return
a) The customer does not acquire a right to the provision of certain rooms, unless this has been expressly agreed in text form.
b) Booked rooms are available to the customer from 3 p.m. on the agreed day of arrival. The customer has no right to earlier provision.
c) On the agreed departure day, the rooms must be vacated and made available to the hotel by 11:00 a.m. at the latest. Thereafter, the hotel may charge 50% of the full accommodation price (list price) due to the delayed vacating of the room for its use in excess of the contract until 6:00 p.m., and 100% from 6:00 p.m. onwards. Contractual claims of the customer are not justified by this. The customer is free to prove that the hotel has no or a significantly lower claim to a usage fee.
Pets
Pets are not allowed in the entire hotel.
Parking conditions for motor vehicles
Use of the parking spaces is subject to acceptance of the following parking conditions and at the guest's own risk. There will be no safekeeping of objects. The hotel assumes no liability for damages caused by third parties. The hotel is only liable for damage that can be proven to have been caused by gross negligence or intent on the part of the staff. Claims arising from such damage must be made before leaving the parking lot or underground garage. The regulations of the road traffic regulations apply accordingly.
Liability of the hotel
a) The hotel is liable for its obligations under the contract. Claims of the customer for damages are excluded. Excluded from this are damages resulting from injury to life, body or health if the hotel is responsible for the breach of duty, other damages resulting from an intentional or grossly negligent breach of duty by the hotel and damages resulting from an intentional or negligent breach of typical contractual duties by the hotel. A breach of duty by the hotel is equivalent to a breach of duty by a legal representative or vicarious agent. In the event of disruptions or deficiencies in the hotel's services, the hotel shall endeavor to remedy such upon knowledge thereof or upon immediate complaint by the customer. The customer is obligated to contribute what he can reasonably be expected to do in order to remedy the disruption and keep any possible damage to a minimum.
b) The hotel shall be liable to the customer for items brought into the hotel in accordance with the statutory provisions. Accordingly, the liability is limited to one hundred times the room rate, but not more than € 3,500, - and differently for money, securities and valuables not more than € 800. Money, securities and valuables can be stored in the hotel or room safe up to a maximum value of € 1,500. The hotel recommends making use of this possibility.
c) Insofar as a parking space is made available to the customer in the hotel garage or in a hotel parking lot, even for a fee, this does not constitute a safekeeping agreement. In the event of loss of or damage to motor vehicles parked or maneuvered on hotel property and their contents, the hotel shall not be liable, except in cases of intent or gross negligence. For the exclusion of the customer's claims for damages, the provision of the above number a), sentences 2 to 4 shall apply accordingly.
d) Wake-up calls are carried out by the hotel with the utmost care. Messages, mail and merchandise shipments for the guests will be handled with care. The hotel will take care of delivery, safekeeping and - upon request - forwarding of the same against payment. For the exclusion of claims for damages by the customer, the provision of the above number a), sentences 2 to 4 shall apply accordingly.
Final provisions
a) The guest is obligated to the hotel to claim the loss of any items brought into the hotel immediately, at the latest, however, upon departure.
b) The guest is liable for all damages caused by him during his stay in the hotel. That means e.g. our hotel is a non-smoking hotel and should we find out that smoking has been in a room, we will charge € 250,-- for the final cleaning. In the case of unauthorized SMOKING IN THE ROOM and the associated false alarm, the costs of approximately € 1,000.00 will be charged to the causer.
c) The headings in these General Terms and Conditions are for convenience only and have no material meaning, especially not for those of a final regulation.
d) The place of jurisdiction is the local or regional court responsible for the respective location of the hotel.
e) Changes and additions to the contract, the acceptance of the application or these General Terms and Conditions shall be made in text form. Unilateral changes or additions by the customer are invalid.
f) The place of performance and payment is the location of the hotel. General Terms and Conditions for the Hotel Accommodation Contract
g) The exclusive place of jurisdiction - also for disputes regarding checks and bills of exchange - in commercial transactions shall be the registered office of the hotel under company law. If a contractual partner fulfills the requirements of § 38 paragraph 2 of the German Code of Civil Procedure (ZPO) and does not have a general place of jurisdiction in Germany, the place of jurisdiction shall be the registered office of the hotel under company law.
h) German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws is excluded.
i) Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
